MEDEA PRESENTS “ILLUMINATED LIES” (THE “PROJECT”)

TERMS & CONDITIONS FOR SUBMISSIONS

This microsite (the “Site”) invites you to share your personal accounts of disinformation and fake news and describe how your experience has impacted on your life and the lives of the people you know.

The Project will consist of:

  • One or more immersive art projects (each an “Installation”), commencing with our installation at the Edinburgh Fringe on 17-25 August 2024, presenting real stories of people affected by disinformation and fake news;

  • An online archive of stories submitted to us during the course of the Project, to be hosted at https://www.illuminatedlies.com and available to view by the general public while the Project is live (the “Archive”).

Although we can’t promise that your story will feature in the Project, we undertake to listen to every submission we receive and will give each of them proper consideration.

With your support we hope that our installations will be impactful and reach the widest possible audience. For the sake of transparency and your peace of mind, we have devised a few simple rules which will apply to the content of any email or sound recording you choose to submit to us (a “Contribution”):

  • These terms and conditions (“Terms”) will become binding on you from the moment when your Contribution has been submitted to us via the Site submission form or otherwise. If you change your mind you may withdraw your Contribution by writing to us up to 7 days following your submission. If you do not agree with our Terms, please do not upload Contributions or use the Site.

  • By submitting a Contribution, you grant to us an unrestricted, unlimited and irrevocable right (but not the obligation) to use, reproduce alone or in conjunction with other media, publish, broadcast, display, store, cache, publicly perform, re-record, translate, edit, adapt, dramatise, subtitle, redact, excerpt and distribute your Contribution in any and all media formats and channels in relation to the Installation and/or the Archive, subject to the Contribution being selected for publication. Contributions not selected for publication will be subject to our deletion policy below.

  • We encourage participants to share their Contribution by way of a vocal recording, but Contributions may also be written. All Contributions, irrespective of how they are submitted, may or may not be spoken by an actor, quoted, dramatised or paraphrased as part of the Installation and will also be listened to by Medea’s staff and other third parties involved with the Installation. As such, any Contribution provided to us via the Site or otherwise should be considered non-confidential and, by posting a Contribution, you agree that we may make use of it in any manner connected with the Project as we consider appropriate.

  • We may contact you following submission of your Contribution to discuss your story, to address any legal and/or technical matters and, if your Contribution is selected for inclusion in an Installation, to arrange a re-recording. We will only share your identity with your written permission, but we will not be obliged to do so (even if you give consent to being identified by name).

  • In order to preserve anonymity and the security of your personal information, we ask that only first names (or pseudonyms) should be used when recording a Contribution except where the third party(ies) in question are business entities, public bodies, government agencies or public figures. We reserve the right to use the names as supplied in each Contribution and, if provided, city or regional locations of the individual(s) concerned. We fully reserve sole discretion as to all decisions concerning the identification of any party who features in a Contribution and our decision shall be final.

  • Wherever practicable contributions should not include information capable of identifying an individual referred to in a Contribution in any circumstances (for example, references to ‘my boyfriend’ would be acceptable but not ‘my boyfriend Adam’). This is to avoid Medea or others involved in the Project being exposed to claims involving defamation or infringement of an individual’s privacy or data protection rights. We reserve the right to redact, otherwise edit or delete any Contribution where this rule is not adhered to.

  • We will process any personal information you provide at the point or after submission of your Contribution (generally your full name, email address, contact address and telephone number) in line with our Privacy Policy [LINK].

  • Users under 16 years of age are strictly prohibited from posting Contributions.

  • Contributions must be limited to 1000 words (if written) or 7 minutes in length (if recorded), subject in all cases to a file size limit of 20 megabytes if sent vi google mail. If trying to send larger files please send via WeTransfer to hello@illuminatedlies.com. In exceptional circumstances we may contact you in order to arrange for a longer Contribution if your story is particularly noteworthy or a longer excerpt is appropriate for the Installation.

  • We undertake to delete all Contributions which are not selected for use in the Project (including all personal data) within sixty (60) days following the decision not to use them. Personal data contained in Contributions used in relation to the Project will be retained until after the Project has ended and then deleted in accordance with Medea’s data retention policy.

  • In sharing your Contribution you warrant the following:

    • Your Contribution does not violate the rights of any other person (including without limitation copyright or moral rights, or where the Contribution amounts to breach a confidence to another person);

    • If you are sharing another person’s story, that you have sought their permission to share their story and will provide written confirmation from the person in question if we ask for it;

    • Your Contribution is not false, inaccurate or misleading;

    • Your Contribution is not obscene, threatening, violent, defamatory, liable to endanger another person or otherwise likely to be objectionable to Installation visitors (as determined by us);

    • Your Contribution is not designed to ridicule, disparage, intimidate, harass, threaten, abuse or discriminate against anyone;

    • Your Contribution should not refer to any company or business except where necessary to tell your story, or be designed to promote any product or service;

    • Your Contribution does not violate any applicable law, regulation, or rule, or amount to a contempt of court.

  • You agree to hold Medea and its personnel free and harmless from any liability that arises in relation to your breach of any of the warranties above.

  • You are not entitled to payment or any other form of compensation for your Contribution.
